Many developments do not need Planning Permission if they are within the scope of Permitted Development rules, including small rear extensions, loft conversions and outbuildings. However, the Permitted Development rules are strict and nuanced. Many developments end up being subject to Planning Enforcement where they thought, or had been told by, for example, a builder, that no Planning Permission would be required for a development.
A small, single storey rear extension may not need Planning Permission if it is under a certain height, and volume ( along with many other factors ), but it is also important that it doesn't take up more than a given percentage of the total area of the site, is built out of the correct materials and wouldn't breach Building Control Regulations.
For peace of mind ( and to ensure legal compliance ) it is always recommended to obtain a Certificate of Lawful Development prior to commencing any work.
Whats involved?
The process of obtaining a Certificate of Lawful Development is similar to other planning routes.
Upon instruction, we complete a measured survey of your property and produce plans and elevation drawings, showing the existing and the proposed. The application is made directly to the Local Authority using the Government's Planning Portal. Along with the plans and elevation drawings, mapping showing the development property is always required, and in some circumstances, additional mapping, such as block plans are required. Occasionally supplementary documentation is required, especially if the property is in a Conservation Area, or National Park.
How long does it take?
From instruction, we aim to undertake the survey and complete all plans, documents and submission to the Local Authority with 7 days. Once the application has been validated, allow 12 weeks for a decision. There has to be a statutory period to allow for public consultation. Most applications are straightforward, however occasionally the decision needs to made by a Planning Committee as opposed to directly by the planning team.
In order to prevent time being wasted, we actively engage with the appointed planning officer during the process in order to intervene and make changes to the proposed scheme if there is an indication that the application could fail.
We manage the whole process
Our work doesn't end when your plans and application are complete and have been submitted. We deal with every element of the process, including arranging site visits by the appointed Planning Officer. Your main involvement will be discussing and agreeing to the design at survey stage - we endeavour to make the process interesting and enjoyable.
How much does it cost?
Our fees are agreed and fixed upon instruction. We don't charge by the hour. You will know exactly what are fees are in advance. The only additional fees are the Local Authority fees.
